Terms of Use

These Terms of Use ("Terms") govern your access to and use of the TrAIder Bot service, including our Telegram bot and our website located at https://traiderbot.io (collectively, the "Service"). By accessing or using the Service you (a) acknowledge you have read and understood these Terms; (b) represent you have the legal capacity and authority to enter into a binding agreement; and (c) agree to be bound. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. Eligibility

You affirm that you: (i) are at least the age of majority (18+ unless a higher age applies in your jurisdiction); (ii) have full power and authority to enter into these Terms; (iii) are not barred by sanctions, export controls, embargoes, or other legal restrictions; and (iv) are not a resident of a jurisdiction where access to AI crypto analytics is prohibited. If using the Service on behalf of an entity, you represent you have authority to bind it and that both you and the entity accept these Terms.

2. Description of the Service

TrAIder Bot is an AI‑powered assistant that generates and delivers technical analyses, market summaries, heuristic pattern detections, indicative price zones, volatility / momentum snapshots, clustering visualizations, and illustrative or hypothetical trade scenarios (collectively, “AI Outputs”). AI Outputs are machine‑generated heuristics and may be incomplete, approximate, stale, contradictory, distorted, latency‑affected, or contain hallucinations or parsing errors. They are provided strictly for general informational and educational purposes and do not constitute investment, financial, tax, legal, accounting, compliance, or other professional advice.

3. Acceptable Use

You must not (partial list): (a) attempt unauthorized access, penetration testing, or circumvention of controls; (b) scrape, harvest, bulk‑export, or replicate outputs at scale; (c) deploy adversarial prompts, model‑poisoning, or exploit vulnerabilities; (d) use outputs as unreviewed trading signals fed directly into automated execution systems; (e) resell, sublicense, or provide shadow advisory, copy‑trading, or regulated broker‑dealer style services derived from AI Outputs; (f) impersonate any person or entity; (g) disseminate malware, spam, malicious scripts, or disrupt platform integrity; (h) engage in market manipulation (wash trading, spoofing, layering, pump‑and‑dump coordination); (i) infringe intellectual property, privacy, or publicity rights; (j) violate sanctions, anti‑money‑laundering, anti‑fraud, or export control laws. Violations may result in suspension or termination without notice.

4. No Financial / Fiduciary Advice

AI Outputs (including any “setup”, “entry”, “stop”, “target”, “risk metric”, “projection”, “confidence value”, or “strategy outline”) are not recommendations, solicitations, endorsements, suitability analyses, portfolio strategies, risk management directives, investment research under any jurisdictional definition, or offers to transact. No advisory, fiduciary, client, broker, agent, or partnership relationship is created. You must conduct independent research (“DYOR”), validate critical parameters, and consult qualified licensed professionals before acting. Trading digital assets (including derivatives, leveraged products, margin instruments, or perpetuals) involves substantial risk—including total loss of capital.

User Warranty: You represent you will not rely on any single AI Output as the sole basis for a trading or investment decision and will implement appropriate position sizing, risk controls, and independent verification.

5. Intellectual Property

All code, models, datasets (curated or synthetic), embeddings, architectural designs, visualizations, compiled assets, UX flows, brand elements, selection, coordination and arrangement (collectively, “Service Materials”) are owned or licensed by us. Except for a limited, revocable, non‑transferable right to access the Service strictly as intended, no license or rights (express, implied, by estoppel, or otherwise) are granted. You must not reproduce, distribute, publicly display, mirror, adapt, translate, create derivative works, reverse engineer, decompile, disassemble, attempt to extract model weights, system prompts, embeddings, hidden parameters, or fingerprint the architecture except as expressly permitted by mandatory law.

6. Disclaimers; Allocation of Risk; Limitation of Liability

THE SERVICE AND ALL AI OUTPUTS ARE PROVIDED “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS” WITHOUT WARRANTIES OF ANY KIND—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON‑INFRINGEMENT, DATA ACCURACY, SYSTEM INTEGRATION, OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, RELIABLE, CURRENT, ERROR‑FREE, FREE OF HALLUCINATIONS, UNINTERRUPTED, TIMELY, SECURE, OR SUITABLE FOR ANY DECISION, OR THAT DEFECTS WILL BE CORRECTED.

NO GUARANTEE OF RESULTS. Historical, hypothetical, simulated, or backtested scenarios (explicit or implicit) DO NOT guarantee future performance. Model drift, data provider errors, latency, partial outages, rate limits, or evolving market structure may materially impact AI Outputs without notice. We owe no duty to monitor, update, correct, or re‑issue outputs.

LIMITATION. TO THE FULLEST EXTENT PERMITTED BY LAW, TRAIDER BOT AND ITS OPERATORS, CONTRIBUTORS, LICENSORS, DATA SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, MULTIPLE, OR AGGRAVATED DAMAGES; LOSS OF PROFITS, CAPITAL, REVENUE, DATA, GOODWILL, OPPORTUNITY, ANTICIPATED SAVINGS, OR BUSINESS INTERRUPTION; COST OF SUBSTITUTE SERVICES; REGULATORY, TAX, OR COMPLIANCE EXPOSURE; OR TRADING LOSSES—ARISING OUT OF OR RELATING TO (i) USE OR INABILITY TO USE THE SERVICE; (ii) RELIANCE (DIRECT OR INDIRECT) ON AI OUTPUTS; (iii) SECURITY INCIDENTS OR THIRD‑PARTY PLATFORM FAILURES; OR (iv) ANY THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE)—EVEN IF ADVISED OF THE POSSIBILITY.

CAP. WHERE LIABILITY CANNOT BE FULLY DISCLAIMED, THE AGGREGATE LIABILITY OF TRAIDER BOT TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF USD $25 OR THE AMOUNT (IF ANY) PAID BY YOU FOR THE SERVICE IN THE THREE (3) CALENDAR MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. MULTIPLE CLAIMS DO NOT ENLARGE THIS LIMIT.

FOUNDATIONAL BASIS. The exclusions and limitations herein are fundamental elements of the bargain and apply notwithstanding failure of essential purpose of any remedy.

7. Modifications

We may revise these Terms at any time. Revisions are effective upon posting (or the stated effective date). Your continued use after the effective date constitutes acceptance. We have no obligation to provide individualized notice. If you do not agree, you must discontinue use.

8. Suspension / Termination

We may suspend, throttle, restrict, or terminate access (in whole or part) immediately and without liability if: (a) you breach these Terms; (b) we suspect abuse, fraud, regulatory risk, security threat, or platform integrity degradation; (c) required by law or third‑party provider constraints. Provisions intended to survive (including Intellectual Property, Disclaimers, Limitation, Indemnity, Governing Law) shall continue in force.

9. Governing Law; Venue

These Terms and any dispute arising out of or relating hereto shall be governed by the laws of the Kingdom of Spain, without regard to conflict of laws principles. Exclusive jurisdiction and venue reside in the competent courts of Málaga, Spain, and you consent to such jurisdiction and waive objections to forum non conveniens. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

10. Indemnification

You agree to defend, indemnify, and hold harmless TrAIder Bot and its operators, contributors, licensors, service providers, and affiliates from and against any and all claims, demands, investigations, proceedings, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ and experts’ fees) arising out of or relating to: (i) your use or misuse of the Service; (ii) reliance (direct or indirect) on AI Outputs; (iii) breach of these Terms; (iv) violation of law or third‑party rights; or (v) any trading, tax, reporting, or compliance consequence attributable to your actions.
